I purchased these on a whim because they were on sale, prior to a long 12 hour flight. Noise cancelling head phones are expensive. I was pleasantly surprised upon using them for the first time as to how well they did at cancelling the noise out even though that's not what they're marketed for. Were they perfect? Of course not, but again that's not what they're marketed as/for.

We've never had this issue before. I would return it to the store saying it's defective and get a replacement, especially since it's new to you. If you're not ready to return it I would contact the Best Buy staff through chat online. I've found them very helpful in the past.
